Terms of Service – Ruminate

Effective Date: 3 March 2026

These Terms of Service govern your use of the Ruminate website and your booking of any guided hiking experience or related service.

By booking with Ruminate, you agree to the following terms.

2. Nature of Our Services

Ruminate provides guided hiking experiences on Table Mountain and surrounding areas in Cape Town.

All experiences are outdoor adventure activities that involve uneven terrain, elevation gain, changing weather conditions, and inherent physical risk.


3. Assumption of Risk

By booking a hike, you acknowledge that:

  • Hiking involves inherent risks, including slips, falls, weather exposure, and natural hazards.

  • You voluntarily participate at your own risk.

  • You accept responsibility for your personal safety and physical readiness.

Ruminate takes reasonable precautions but cannot eliminate all risks associated with outdoor activities.


4. Fitness & Medical Responsibility

You confirm that:

  • You are physically capable of completing the hike you have booked.

  • You have disclosed any medical conditions that may affect your safety.

Ruminate reserves the right to refuse participation or turn a participant back if safety is a concern.


5. Punctuality

All hikes depart at the scheduled time.

  • Guests arriving more than 10 minutes late will be considered a no-show.

  • The booking will be forfeited in full.

This ensures fairness to other guests and maintains safety timing windows on the mountain.


6. Cancellations

Cancellations made within 24 hours of the scheduled start time are non-refundable (0% refund).

Refunds outside of this period may be granted at Ruminate’s discretion, taking into account operational costs.

7. Weather & Route Changes

Table Mountain weather can change rapidly.

Ruminate reserves the right to:

  • Cancel a hike if conditions are unsafe.

  • Reschedule a hike due to weather or official closures.

  • Change the hiking route to a safer alternative on Table Mountain if conditions require it.

If Ruminate cancels due to unsafe conditions, you may choose a full refund or reschedule.

Cableway closures do not automatically qualify for cancellation.


8. Turn-Back Policy

If a participant cannot safely continue due to fitness level, mobility limitations, or safety concerns, the guide may turn the participant back.

In such cases, the booking is considered partially fulfilled and no refund will be issued.


9. Third-Party Activities

If you book third-party experiences through Ruminate, those services are operated by independent providers.

Their terms and cancellation policies apply to those bookings.

Ruminate is not liable for the performance or safety of third-party operators.


10. Limitation of Liability

To the maximum extent permitted by South African law:

  • Ruminate is not liable for indirect, incidental, or consequential damages.

  • Ruminate is not responsible for events beyond its reasonable control, including weather changes, wildfire, government restrictions, cableway closures, or force majeure events.

Nothing in these terms excludes liability where it would be unlawful to do so under the Consumer Protection Act.


11. Governing Law

These Terms are governed by the laws of South Africa.

Any disputes shall be subject to the jurisdiction of the courts of Cape Town, South Africa.
